Introduction and Acceptance of Terms These Terms and Conditions (“Terms”) govern your use of the Vishra Spa website and all services, including home-based spa treatments (collectively, “Services”). By accessing our website, booking a service, or clicking “I Accept,” you (“Client,” “You”) agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
Service Booking, Cancellation, and Payment ● Booking Confirmation: All service bookings are subject to availability and confirmation by Vishra Spa. A booking is confirmed only upon receipt of the initial deposit or full payment as specified at the time of booking. ● Pricing and Payment: All prices are quoted in Indian Rupees (INR) and are subject to applicable taxes. Full payment is required prior to or immediately following the service, as mutually agreed upon. ● Client Location: Services are provided at the Client’s specified location (home, hotel, apartment, office, etc.). The Client is responsible for ensuring the location is safe, appropriate, and has adequate space for the service to be performed. ● Cancellation Policy: (You should define this clearly. Example:) Cancellations made 24 hours prior to the scheduled appointment will receive a full refund. Cancellations made less than 24 hours prior will forfeit the deposit or incur a 50% charge of the service fee.
Client Health, Confidentiality, and Refusal of Service ● Health and Medical Disclosure: The Client must inform Vishra Spa of any relevant medical conditions, allergies, pregnancy status, recent surgeries, or health concerns prior to booking. Failure to disclose may result in the service being refused or modified. ● Professional Conduct: All Vishra Spa service providers are highly trained professionals. Services are strictly non-sexual. Any improper or inappropriate advances, language, or conduct by the Client will result in the immediate termination of the service without a refund. ● Right to Refuse Service: Vishra Spa reserves the absolute right to refuse or terminate any service immediately, without refund, if the service provider feels unsafe, the client appears to be under the influence of drugs or alcohol, or if the Client’s behaviour violates these Terms.
Client Responsibility for Service Provider Safety (Your Required Clause) This section is paramount for the safety of our staff: With my full consent, I have read and understood the rules and regulations stated on the website, and I have selected the service provider with my full knowledge. I have invited them to my location (home, hotel, apartment, office, etc.). The safety and security of the service provider while on my premises are solely my responsibility. 4.2. Duty to Provide Safe Environment: The Client is solely responsible for ensuring the location of the service is free from known hazards, threats, or risks to the service provider. 4.3. Indemnity: The Client agrees to indemnify and hold harmless Vishra Spa and its service providers from any claims, losses, or damages arising out of the safety or condition of the Client’s premises.
Limitation of Liability and Indemnity Vishra Spa shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of the Services, except where prohibited by law. The Client agrees to indemnify and hold Vishra Spa harmless against any claims arising from the Client’s breach of these Terms.
Changes to Terms Vishra Spa reserves the right to update or change these Terms at any time without prior notice. The most current version of the Terms will be posted on the website.
Governing Law These Terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in
